Terms and Conditions
These terms govern your use of SmartCRM, provided by SOFTURECS AI LABS PRIVATE LIMITED. By creating an account or signing in you agree to them. If you use SmartCRM on behalf of a business, you confirm you are authorised to bind that business.
1. The Service
SmartCRM is customer relationship, support, sales, HR and communication software offered as a subscription to businesses ("Workspaces"). Team members use it under their Workspace's account; customers of a Workspace may use the customer portal to view invoices, raise tickets, chat and join meetings.
2. Accounts
- Keep your password confidential and tell us at once about any unauthorised use.
- Your Workspace administrator controls your role, permissions and can remove your access.
- You must be at least 18 years old.
3. Acceptable use
You agree not to: send spam or unsolicited messages; break WhatsApp, telephony or email provider rules; upload unlawful, infringing or harmful content; record calls without the consent required by law; attempt to access data you are not permitted to see; or reverse engineer or resell the Service.
4. Messaging, calls and monitoring
The Workspace is responsible for obtaining the consents needed to message, call, record or monitor people through SmartCRM, and for the content it sends. Employee Monitoring features must be used with a notice to employees and in line with local labour and privacy law.
5. Fees and credits
Subscription fees, messaging credits and AI usage are billed to the Workspace as agreed in its order or shown in the web application. Prices are in Indian Rupees unless stated and exclude taxes. Unpaid amounts may lead to suspension. Refunds are handled under our Refund Policy.
6. Your data
The Workspace owns the business data it stores. You grant us the rights needed to host, process and back it up to provide the Service. Our Privacy Policy explains how personal data is handled.
7. Availability
We aim for high availability but the Service may be interrupted for maintenance or reasons beyond our control. We may change or discontinue features with reasonable notice.
8. Intellectual property
SmartCRM, its software, design and trademarks belong to Softurecs or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the app for your Workspace's business.
9. Third-party services
WhatsApp Business, telephony, payment gateways, maps and similar services are provided by third parties under their own terms. We are not responsible for their availability or content.
10. Disclaimer and liability
The Service is provided "as is". To the extent permitted by law, Softurecs is not liable for indirect, incidental or consequential loss, and our total liability for any claim is limited to the fees paid by the Workspace for the three months before the claim.
11. Termination
You may stop using the Service at any time and delete your account. We may suspend or end access for breach of these terms or non-payment. Sections that by nature should survive (fees owed, data, liability) survive termination.
12. Governing law
These terms are governed by the laws of India. Courts at Hyderabad, Telangana have exclusive jurisdiction.
